Its a matter of Trust

Time to let the kat out of the bag.   Went to Courthouse to settle the property issues.   Problem being that Da and Unk seem to think the world still operates on 1960 Trust protocols,,,

Um, No,,, sad as that is,, NO.   Those days of trusting your neighbors that far are long gone: the lawyers made sure of it, and the land of Lawsuits and liability continues its drift into a quagmire of redtape and hoops.

So, quick stop at a lawyers office to draw up paperwork, or at least get the ball rolling (with the caveat of ‘It must be made ready for signing before Friday as Unk moves to Floriduh with his son come Satyrday.’) 

what happened prior to that?  what changed?   Knowing that Unk was moving out of state, his health situation, I put the ax to the stone and started making sparks.  To quote me at one point “He might drop dead before he ever gets back here and that puts the whole property issue at the whims of the courts, (no will) and I really don’t wanna get in the middle of a family squabble because the agreement is between him and I, NOT HIS SON OR THE COURTS”   Well, the original agreement was a two way split.  Its now, “The whole enchilada”   Not that it’s much: I mean, about 3 acres of primo Kentuck hillside that grows rocks and weeds with passion, and not much else.   It does have some flat areas well defined, so putting up a barn or shop or whutevs is very doable.   

The real advantage is the leverage it gives me.   Financially speaking, sole owner, no mortgage, I could establish a means to consolidate my debts into one, and with enough room to pay for said building,,,   Its just a thought, not a plan at this point.   And I would need to remove Unks trailer from the picture  (which is more than likely, several reasons best left to the imagination)

Now, let me take a quick  jaunt down this alleyway with a little different story involving the above changes.

Bad Cuz’s GF flagged me down as I was coming back from the morning events already described.   She tossed me an offer ‘we could pay you $275/mo to rent that trailer’ .   <hard pause on my part>   ‘No, Seriously, no offense, but I think I wanna put up a barn/shop and work from home.’   I was extremely civil in my response because my reaction would have been “HA! to your White trash Ass? I’d rather burn it down, with you in it!”   I didn’t say that, of course, but the thought flew across the viewscreen of my brain as an option.  

Well, I kept thinkin’bout it for a bit, then gathered up some pop and beer cans (more as an excuse to make the visit) and headed over.   As I and Cozzie were walking up, she came up with a second offer of $300/mo, but I shut that down with “Mary, I’m gonna toss something out here that I am certain you hadn’t considered.  As a landlord, its my right, as a property owner, to make stipulations about HOW my tenents are permitted to reside on my property; Can you agree with that?”  ‘yeah, thats true’.   and then the rusty gears in her head started turning.

‘I’d keep the dogs out of the house!’.  

“Thats beside the point.  I think you are letting your dogs breed past the point of control: I’ve been saying it for three years.  They are packing up, creating issues in the neighborhood, and if one of them bit someone, on my property, even though you are the renter, I could be sued. NOT YOU, and I could lose my property.   Not a risk I want to take.”

Least to say, that answer didn’t give her warm fuzzy thoughts.   She even said, “I only want to live there because the electric is already in place”   To which I replied, “you have a juice pole in place.  Take that money you are trying to spend with me for rent, and get your electric hook up.”   To which I got BAD dirty looks from BadCuz,,,, ROFLMAO   I know the deal, he’s trying to drive her off and can’t man up and tell her to ‘get-gone’

end of story digression.   

There are other things going on behind the scenes here as well, but the state of flux they are in, I don’t even want to record the mess to be honest.   its bad enough my hair is going even further silver, recording this mess would only add to it.   I’ll let the mess settle down into some gelatinous mass that something can be done with.   And its not me thats the issue; nope, its the Da and his second guessing himself.   Wishy-washy as F! of late.

I abide, and seek the center ground to prod him in SOME direction.  

When did I become the Ambassador and Diplomat?   Fu,,, this sucks.  I prefer the ‘in your face’ methods better.

I know, I know,,,, Just because I can see the solution, doesn ‘t mean everyone can.    And when you are in the thick of it, some solutions will avoid detection.  (found that out in writing.  You need those second and third set of eyes on the target to make sure.)

So, I ain’t ded yet, My ‘worldly’ situation is getting some solidity back to it, and while nothing has really changed, financially for me, I can see a light.

I just hope its not an oncoming train.

  1. Dammit man! Looks like ya gotz all kinda legal stuff going on – and all kinda possible options. One of em will work out best fer sure.

    Yer absolutely right about that trust thing, too. I operated thataway for a long time – took some semi serious sheeiitt to make me open mine eyes. Ain’t a-gonna go back, either. Wish it could, though – miss that trust a lot. Is what it is, though. Make do the best way possible.

  2. I’m not sure what the landlord and property rental laws are like up there. But i had a rental property once. The steady income was nice. I got sued over a security deposit once. The biggest thing is to do your due diligence on your tenants.

    DO NOT RENT TO SECTION 8!!! The easy answer is “I do not wish to be a government contractor” because anything else is discrimination… The problems occur if you have to evict a tenant. They can absolutely destroy your rental property before you get them out. I personally know a lady who’s mother lost a property over a section 8 tenant that she couldn’t get rid of and the property went into foreclosure because they weren’t paying rent and she couldn’t make the nut without the rent.

    Rental income is nice if you’ve got good tenants. And you gotta take care of broken stuff quick. It helps if you’ve got the tools and skills to fix everything yourself. If you gotta pay someone to fix things it eats your profit fast. Really fast!

    Tenants will sue you over something quick. Especially if they’re stupid and immature.

    A hole in the driveway finishes off the bad ball joint in their junk car. Or they trip over a loose step when they’re blind drunk or stoned. Or their dog bites someone. There’s a thousand hazards that an idiot won’t see. And there’s too many lawyers in America. But you already said that.

    A separate building for your office and tool storage is a tax writeoff. A home office is a tax code nightmare. The separate building makes it easier as well as being a backup bathroom or guest quarters for a once in a while visitor.

    Ponder it carefully. You’ll see the path.

    1. indeed. Landlord rental laws are a mess up here. Takes about 6 months for an eviction to work through, from what Son of Bossman told me. In that time, they live there rent free, and you can’t do anything about the damage they are doing. Its why he sold off his rentals a couple years back. Got fed up with it. Granted, he was also renting to crappy tenents, no background checks etc, and it bit him hard. IF I go that route, I may end up not renting for some time as I wouild be meticulous about WHOM I would rent to. And that alone leans against renting at all.
